NY school and facility lead testing, explained

Under New York’s school lead-in-water testing law (Public Health Law §1110 and 10 NYCRR Subpart 67-4), every public school district and BOCES in New York must periodically test the drinking-water outlets students and staff use for lead — there is no opt-out. Schools collect first-draw samples from each covered outlet, and any outlet at or above the state action level of 5 parts per billion (ppb) — lowered from 15 ppb by the 2023 amendments — must be taken out of service until it is remediated and an alternate source of drinking water is provided. Testing repeats on a recurring cycle (generally at least every three years).

Schools must use a laboratory approved under New York’s Environmental Laboratory Approval Program (ELAP) for lead-in-drinking-water analysis, and follow standard first-draw sampling protocol — samples collected after water has sat in the plumbing overnight or over a weekend, when lead levels are highest. Results and any remediation must be reported to the local health department and the New York State Department of Health (NYSDOH), shared with the State Education Department, communicated to parents and staff, and posted publicly. Non-school facilities (offices, gyms, and other commercial buildings) aren't subject to the school lead-in-water testing regulation, but the same testing and maintenance principles apply as good practice for any building with public drinking water fixtures, particularly older buildings where original plumbing or fixtures may predate the 1986 federal restrictions on lead in plumbing materials.

Drinking water plan checklist

Whether or not your school or facility tests annually, a written drinking water plan turns a one-time decision into an ongoing, defensible process. At minimum, that plan should cover:

  • Build a fixture inventory: list every drinking fountain, bottle filler, and kitchen tap used for drinking or cooking, with location and fixture type
  • Confirm your testing cycle and schedule sampling for every covered outlet — public schools must test, there is no opt-out
  • Use an ELAP-approved laboratory and follow standard sampling protocol (first-draw samples after overnight stagnation)
  • Document results and any fixtures taken out of service, including the date and reason
  • Take any outlet at or above 5 ppb out of service, report results to your local health department and NYSDOH, and notify staff and parents
