New York’s law requires testing — it is not optional. Under Public Health Law §1110 and 10 NYCRR Subpart 67-4, every public school district and BOCES must test the potable water outlets students and staff use for drinking and food preparation for lead, on a recurring cycle (generally at least every three years). There is no public-meeting alternative that substitutes for testing.

The rule first took effect in 2016 and was strengthened by amendments in 2023 that lowered the action level, expanded which outlets must be sampled, and set the recurring re-testing schedule. Federal WIIN Act funding (covered below) can offset the cost of testing and remediation.

How proper first-draw sampling works

The standard approach follows EPA's 3Ts (Training, Testing, and Taking Action) guidance for schools and child care facilities:

  • Water must sit stagnant in the plumbing for at least 8-18 hours before sampling — typically achieved by sampling first thing in the morning, before any fixtures have been used since the prior evening
  • The first liter drawn from each fixture ("first-draw") is collected in a dedicated sample container without running the water first
  • Every fixture used for drinking or food preparation is sampled individually — a building-wide average isn't sufficient, since lead contamination is typically fixture-specific rather than building-wide
  • Samples are labeled with fixture location and sent to a laboratory approved under New York’s Environmental Laboratory Approval Program (ELAP) for lead-in-drinking-water analysis

Action level

Two different thresholds — don't mix them up

This is a common point of confusion, so it's worth being precise: New York's action level for school drinking water is 5 parts per billion (ppb) — lowered from 15 ppb by the 2023 amendments. Any outlet with a lead result at or above 5 ppb must be taken out of service until it is remediated, and the school must provide an alternate source of drinking water. This school-specific 5 ppb level is separate from the EPA's general 15 ppb action level, which applies to public water systems broadly under the federal Lead and Copper Rule. For a New York school, the operative number is 5 ppb, not 15 ppb.

There is no known safe level of lead exposure for children, which is part of why New York set a school action level (5 ppb) below the general federal 15 ppb figure.

What happens after an elevated result

Under the rule, any outlet at or above the 5 ppb action level triggers a defined response, not an ad hoc one:

  • Immediate: Take the fixture out of service (shut off, bag the tap, or post a "do not drink" sign) until it's addressed
  • Report: Report results to your local health department and the New York State Department of Health, and make results public; results are also shared with the State Education Department
  • Investigate: Determine whether the source is the fixture itself, connecting plumbing, or a building-wide issue
  • Remediate: Options range from flushing protocols and certified filters to fixture replacement or plumbing repair, depending on the cause and severity
  • Re-test: Confirm the fix worked before returning the fixture to service
  • Communicate: Notify staff and parents as appropriate, consistent with your district's communication plan
